1. Acceptance of Terms
By accessing or using DNS Assistant ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service. These Terms apply to all visitors, users, and others who access or use the Service.
2. Description of Service
DNS Assistant provides DNS and WHOIS monitoring services, including but not limited to: DNS record change detection and alerting, WHOIS record monitoring, domain security analysis, multi-tenant organization management, and API access for integration with third-party tools. The Service is provided on a subscription basis with various plan tiers offering different feature sets and usage limits.
3. Account Registration
To use the Service, you must create an account by providing accurate, complete, and current information. You are responsible for safeguarding the password and for all activities that occur under your account. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account. You may not use another person's account without permission.
4. Subscription Plans and Payment
The Service offers Free, Starter, Professional, and Enterprise subscription tiers. Paid subscriptions are billed on a monthly or yearly basis through Stripe. All fees are non-refundable except as required by law. Token purchases (DNS Tokens and WHOIS Tokens) are non-refundable. We reserve the right to change pricing with 30 days' notice to active subscribers. Downgrading a plan takes effect at the end of the current billing period. Upgrading takes effect immediately.
5. Acceptable Use
You agree not to: use the Service to monitor domains to attempt to gain unauthorized access to other users' accounts, systems or data; use the Service for any unlawful purpose or in violation of any applicable laws; interfere with or disrupt the integrity or performance of the Service; attempt to reverse engineer, decompile, or disassemble any part of the Service; use automated tools to scrape or extract data beyond the provided API; resell, sublicense, or redistribute access to the Service without written permission.
6. Data and Privacy
Your use of the Service is also governed by our Privacy Policy. DNS and WHOIS query results are stored to provide monitoring and alerting functionality. Organization administrators have visibility into usage data within their organization as defined by role-based access controls.
7. Multi-Tenant Organizations
Organization administrators are responsible for managing users within their organization, including assigning roles, managing team access, and ensuring compliance with these Terms. When an organization's subscription expires or is canceled, non-administrator users may lose access to the Service until the subscription is renewed.
8. API Usage
API access is subject to rate limits defined by your subscription plan. API keys must be kept confidential and must not be shared publicly. We reserve the right to revoke API access for abuse or violation of these Terms. API usage is logged for security and billing purposes.
9. Service Availability
We strive to maintain high availability but do not guarantee uninterrupted access to the Service. We may perform scheduled maintenance with reasonable notice. We are not liable for any downtime, data loss, or service interruptions beyond our reasonable control.
10. Intellectual Property
The Service and its original content, features, and functionality are owned by DNS Assistant and are protected by international copyright, trademark, and other intellectual property laws. You retain ownership of any data you submit to the Service.
11. Limitation of Liability
To the maximum extent permitted by law, DNS Assistant shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising out of or in connection with your use of the Service. Our total liability shall not exceed the amount paid by you for the Service during the twelve months preceding the claim.
12. Termination
We may terminate or suspend your account immediately, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties, or for any other reason at our sole discretion. Upon termination, your right to use the Service will immediately cease.
13. Changes to Terms
We reserve the right to modify these Terms at any time. We will provide notice of significant changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the Service after any changes constitutes acceptance of the new Terms.
